　 Long time no see, but I have been very busy with our works these days. I set up my firm 3 years ago. Now many clients are getting interested in my business gradually. My business is going very well up until now since I started my own firm.

　It has been a long time since I posted on this blog last time. I have been very very busy for the last three month. I did not have enough time to write my comment on this blog.

　Anyway, this month, we asked the American firm to apply two new US applications. These new applications were filed by using PCT. Fortunately, the inventor will be able to receive the Japanese government subsidy relating to these US applications. Almost half of the fees will be compensated by the government, because Japanese government has been trying to support small companies in terms with patent fees. I hope it will lead to stimulating our economy in the end.

　Last week, I asked a European firm in France to file a new patent application in order to have it enter the European phase from Japan.

　I always think that the official fees at the EPO are very expensive. Their estimated invoice shows that the total of the official fees would be €4,200. In addition to this, we have to pay their service charge. So the total cost would be around €5,000.

　I don’t know why it costs a lot more than other countries. It is no wonder that many companies in Japan hesitate to get patent rights in Europe, since its official fee is very high and most companies in Japan cannot afford to pay such amount of the fee.

　In Japan, the JPO has recently decreased its official fees for trademark application. As a result, the number of trademark applications has been skyrocketting since it started. Therefore, I think that the EPO should consider to mark their prices down in order to attract more foreign customers.

　We have a few PCT applications which are entering America,Europe,and China within this year. And last week, I asked a patent attorney in the US to apply a new patent application from Japan.

　Further, it is expected that we will have more PCT applications, which are going to enter various countries, from Japanese clients. And we have not done yet, but we may have trademark applications, which are going to enter various countries, in the near future.

　In order to deepen the relationship between our firm and Chinese firms, I visited some Chinese firms in Beijing. I show some pictures there.

　Because we have asked some Chinese patent applications to the firms, some firms treated me to lunch or dinner. I know that they showed gratitude to me, and I thanked to them. We exchanged the latest information ralating to Japnese and the Chinese intellectual property and I had a very nice time with them.

　This time, I was able to visit a variety of firms. Some focus on its quality, while others focus on its cost. Therefore, now that I can adjust and select a Chinese firm according to our customer’s preference.

　By the way, as you can see, the smog in Beijing was terrible and beyond my expectation. My visibility was very limited by the smog. I thought that the Chinese economy has developed rapidly, but they have lost so many precious things at the same time. And I enjoyed Chinese food very much. The trip was very fruitful for me.

　We have started to receive jobs from foreign clients. So in order for us to adjust to our customer’s preference, we decided to enroll in Paypal so that foreign clients could pay thier bills via Paypal or wire to the Bank.

　Paypal is very convenient when it comes to the payment.
　All you have to do is to check the bill and click the button in the email that we sent to you after we finish the job. And its remmitance fee is 3.9% of the total bill. I think it has a very reasonable price compared to the charge at the bank. Furthermore,in some instances, sometimes exchanging currency can be very troublesome when paying the fee. However, if you choose Paypal, you are not required to exchange the currency to Japanese yen. You can pay your fee directly with the Japanese yen. This is very useful.

　It goes without saying that you can pay your bill through banks. But if you choose to pay by Paymal, all you need is your credit card information and your paypal account. It is very convenient.

　Last week ,I sent an email to my fellow American attorney, then I received a following message as an automatic reply.

　“I will be on leave until the end of November and if you need immediate assistance, please contact,,,”

　Then I thought what happened to her? I was very surprised and a bit confused, because I rely on her in terms with our American applications. And I was not informed about her leave at all. And, frankly, at the same time, this kind of impression came up in my mind ”Wow,the American people are allowed to have such long holidays. I really envy Americans, it is totally different from Japanese working conditions,,,”

　But later, her fellow worker let me know about her twin babies. Then I totally understood the reason why she was taking such long holidays.

　 In order to attract more foreign customers, we have decided to discount our fee overly for a trademark filing in Japan. Kindly refer to the above picture. We believe that our fee is very attractive for every foreign client.

　And I think that most trademark applications do not meet any major Office Action.

　However, if we recieve a rejection that requires Argument and Amendment, it might cost around $300(it varies with the coplexity of the OA).
　Plus, it is noted that if you request us to conduct translation (Japanese⇔English, Chinese, etc) of the OA, I will charge you translation fee. But, I will try to minimize our translation fee. I will be able to summarize the OA when translating, so that our translation fee would be minimized.

　As you can see, I think that our fee is comparetively lower than other firms in Japan, because I truly would like to get a job from a foreign country and work with foreign partners. 　Do you know what kind of ratio is this number?

　You may not know that the ration of solely operated patent firm to patent firms with over ten patent attorneys in Japan is 3218 to 130. If you like, please refer to the Japan patent attorney association data, April 2017.

　It shows that most patent firms in Japan are solely(one patent attorney) operated firm(about 70%). I believe that those who operate their own firm have better knowledge and experiences rather than those who belong to big conventional big patent firms in Japan.

　 Further, according to the JPO data, in 2015, the Japan patent office accepted 25,998 applications from America, 21,078 applications from Europe, 2,531 applications from China.
　Sad to say, most foreign applications were applied to JPO via big conventional Japanese patent firms, whose fee are far more expensive than small good patent firms in Japan. And it is kind of contradiction for me, because most patent firms in Japan are solely operated firm.

　 Therefore, I strongly recommned that you should find a small good affordable patent firm in Japan and keep in good terms with them. I think that will lead to mutural benefits between foreign firms and Japanese good small firms like us.

　Today I asked an American attorney to prepare and comment on the 1st OA. We ordered the comment to the American firm after they clarified its apporoximate cost for the OA, because we cannot accept exrtaordinary cost from a foreign firm. The apporioximate cost of commentting on the Office Action and preparing and filing a response to the USPTO would be about $〇.

　 Most attoneys in America charge us their fees according to its required time. Flankly, it sounds a bit inconvenient for us, because we cannot count how much cost will be required in the future. Therefore, it is very important for us to know how much cost wil be required beforehand.

　 It is needless to say that our firm will inform you of our apporioximate cost for each case before you decide to order it.

　As you know,in Japan, you have to submit an argument in Japanese and/or an amendment in English. And a signed power of attorney is necessary, if I will be your representative in Japan. Furthermore, you have to be careful when handling an international trademark application through Madrid Protocol to the JPO, ,unlike many other countries, individual fees provided in Article 8(7)(a) of the protocol shall be paid not only where a trademark application based on the Madrid Protocol is filed, but also when the trademark application is to be registered.
